MANEVUM Service Agreement (Enrollment Contract)
Les documents juridiques font foi en anglais ; les contenus français et espagnols ailleurs sur ce site sont fournis pour votre commodité.
This is the agreement a subscriber accepts at enrollment. Electronic acceptance at signup, followed by coordinator confirmation and payment, makes it binding. The Service Policies are incorporated by reference.
1. Parties & Service
This Agreement is between Eviction Property Rescue LLC, operating the MANEVUM platform ("MANEVUM"), and the enrolling tenant ("Subscriber"). MANEVUM provides a prepaid standby property-rescue service: if the Subscriber becomes unable to return home (eviction execution, detention, hospitalization, deportation, or similar sudden displacement), MANEVUM will retrieve, document, pack, seal, transport, and store the Subscriber's belongings from the enrolled property, and return them per Section 7.
2. Authorization of Entry
The Subscriber authorizes MANEVUM to enter the enrolled property and remove the Subscriber's belongings when the service is activated under Section 3. This authorization is given now, while the Subscriber is present and able, and remains valid for the life of the plan. Physical access is provided by the Subscriber's arrangements (a key held by a designated trusted contact, or another recorded arrangement). MANEVUM performs no lock changes and does not alter the property.
3. Activation
The service activates only through: (a) a call from a designated trusted contact, verified against the pre-registered list and confirmed by callback to the registered number; (b) the Subscriber's own request; or (c) a participating county sheriff/marshal office at eviction execution, for subscribers registered under a county agreement. Silence in the monthly wellness check-in never activates the service by itself — it triggers a human investigation only. Every activation includes a documented verification step before any crew enters.
4. Wellness Check-In
MANEVUM sends one short check-in message ("Everything OK?") around the Subscriber's declared rent payment day each month. No reply for 5 consecutive daily attempts flags the file for coordinator investigation (Subscriber first, then trusted contacts, then relevant institutions). The Subscriber may change channel or opt out in writing; opting out removes the no-contact safety net and is recorded.
5. Fees, Membership & Deposit
The plan has three components. (a) A one-time enrollment fee of $100, which includes the first month of membership. (b) A recurring membership of $19.99 per month beginning in month two, which funds the monthly wellness check-ins, the 24/7 activation hotline, the app, and trusted-contact management; the membership may be cancelled at any time and is not refundable for the month in progress. (c) A rescue deposit — the one-time moving/rescue fee plus 3 months of storage per the published table by home size and material occupancy, plus a 15% price-protection reserve — held for the Subscriber's rescue and refundable per Section 10. The price-protection reserve is held in the Subscriber's name and refunded with the deposit if unused; it exists so a rescue can proceed, without the Subscriber's real-time approval, if partner rates or costs have risen by the time of activation. The Subscriber authorizes MANEVUM to charge the payment method on file for documented cost adjustments at activation. If a cost exceeds the reserve and the card cannot be charged while the Subscriber is unreachable, the rescue is still performed and the documented excess is recovered as a secured obligation against the stored property per Service Policy §8–9 — belongings are never abandoned over a cost dispute. The quote shown at enrollment is locked to the Subscriber's declarations; if actual size/occupancy differs at activation, Service Policy §8 applies (the rescue proceeds; the deposit adjusts to the correct published tier). Storage renews monthly after the prepaid period following a rescue; non-payment follows the abandonment and lien procedure of Section 8. A lapsed membership of more than 60 days suspends monitoring (wellness check-ins and county registration) until reinstated, but does not forfeit the deposit.
6. Prohibited & Special Items
Per the Service Policies: no cash handling (§1); jewelry and high-value items must be declared (§2–3); identity documents follow the sealed-envelope protocol (§4); illicit products and drugs are never touched, packed, transported, or stored — on discovery the on-site trusted contact takes charge of them or they stay in place, documented on the rescue video as proof, and knowingly hiding them in MANEVUM custody voids this Agreement (§5); firearms and hazardous materials are likewise excluded — the trusted contact takes charge or they remain secured in place (§6). Liability for undeclared items is limited to $100 per item and $500 total; declared items are covered to declared value subject to bailee insurance terms.
7. Storage, Access & Return
Belongings are stored one-case-per-unit under numbered tamper seals; documents and valuables in a separate safe. The Subscriber (or an authorized representative with documented authority) may retrieve by appointment; seals are verified on camera before opening. Full retrieval, or documented release to the Subscriber's representative — including international shipping at quoted cost for deported subscribers — closes the storage obligation.
8. Non-Payment, No-Contact & Abandonment
If storage lapses unpaid, MANEVUM follows a documented sequence: warnings at days 1/15/30, certified-mail final notice, logged contact attempts including trusted contacts and relevant institutions, then the storage lien process of the state where the property is stored, ending in lawful disposition (auction, donation, disposal). Any Subscriber contact pauses the clock. Identity documents are never disposed of (§4). Deceased-subscriber property transfers only to a verified executor or next of kin.
9. Claims
Claims are answered in writing within 48 hours against the evidence set (video, inventory, seals, custody log, declarations). Knowingly false claims void coverage and this Agreement per Service Policy §7. Confirmed losses are paid through MANEVUM's insurance process; no informal settlements.
10. Term, Cancellation & Refunds
The plan runs month-to-month. Only the Subscriber may cancel, in writing, effective upon callback verification to the registered number (Service Policy §11); an unconfirmed request expires in 14 days. Within the first 14 days of enrollment all amounts are refunded, including the enrollment fee. Thereafter: membership stops at month end; the full deposit is refunded if no rescue has been performed; after a rescue, unused prepaid storage months refund upon retrieval of the belongings; a dispatched rescue is always completed before a cancellation takes effect, with documented costs deducted. Refunds issue to the original payment method within 14 business days. On cancellation, MANEVUM deregisters the address from county lists and sends each trusted contact a closure notice stating only that the designation has ended. DV-flagged accounts require secondary verification through the advocate on file and a 7-day effective delay. Reinstatement within 90 days requires no new enrollment fee. MANEVUM may terminate for material breach (illicit items, fraud, repeated misdeclaration) with prepaid amounts handled per the Policies and state law; a Subscriber's death results in refund of the deposit to the verified estate or next of kin. Domestic-violence protections (Policy §10) survive termination.
11. Liability, Disputes & Law
MANEVUM's aggregate liability is limited to the greater of declared values covered by insurance or the fees paid in the prior 12 months. Disputes go first to written negotiation, then to mediation in Cook County, Illinois, before any court action. This Agreement is governed by Illinois law with state riders where the enrolled property is located. If any clause is unenforceable, the remainder stands.
